Privacy Policy

Effective Date: May 3, 2025

Introduction

Welcome to growthzacks. This Privacy Policy explains how growthzacks consulting LLC (“Company“, “we“, or “us“), the owner of https://www.growthzacks.com/ (including any subdomains such as tools.growthzacks.com) (collectively, the “Site“), collects, uses, shares, and protects information about you when you use our Site, including our online courses, tools, and any related services (collectively, the “Services“). By using the Site or Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with our practices, please do not use our Site or Services.

We are committed to protecting your privacy and being transparent about our data practices. If you have any questions or concerns about this Privacy Policy or your personal information, please contact us at zack.miller@growthzacks.com.

Information We Collect

We collect several types of information from and about users of our Site and Services. This includes:

  • Information You Provide Directly: When you interact with our Site, such as by registering for an online course, filling out forms (e.g., signing up for a newsletter or lead magnet, submitting the “Work With Me” contact form), or contacting us, you may provide personal information. This can include:
    • Contact Information: Your name, email address, phone number, and company name.
    • Account Information: If you create an account to access our courses, we collect a username, email address, and password. We may also record which courses you enroll in and your progress.
    • Communications: The content of any messages or inquiries you send us (for example, questions via email or form submissions), and your contact details so we can respond.
  • Information We Collect Automatically: When you visit our Site or use our Services, we automatically collect certain information about your device and usage via cookies and similar tracking technologies:
    • Usage Data: This includes your IP address, browser type, device type, operating system, referring URLs, pages viewed, links clicked, and the dates/times of access. This information helps us analyze how users use our Site and improve our content and layout.
    • Cookies & Similar Technologies: We use cookies, pixels, and local storage to remember your preferences and recognize you on return visits. For example, if you use certain tools on our Site, a cookie or your browser’s local storage might save your inputs for convenience. Cookies also help us with authentication (keeping you logged in to your account) and gathering analytics information (see Cookies and Tracking Technologies below for details).
  • Information from Third-Party Integrations: Some of our tools and features may request access to third-party accounts or services to function:
    • Facebook Advertising Data: If you choose to use our Rolling Reach Report or similar tools that integrate with Facebook, you will be asked to authenticate with your Facebook account. Upon your authorization, we may access certain data from your Facebook Ads account (such as advertising campaign names, performance metrics, reach, and related analytics data) in order to analyze and present your advertising performance. We do not receive or store your Facebook login credentials. The data retrieved from Facebook is used only to provide you with analysis and is temporarily cached on our server for performance. We do not store this data long-term or use it for any purpose other than running the requested report. Importantly, we do not collect personal information from your Facebook profile (no friend lists, no contact info) – only advertising account data that you have permitted us to access.
    • Future Integrations (Google Ads & Klaviyo): We plan to offer similar analytics tools for other platforms like Google Ads and Klaviyo. If you choose to connect these accounts in the future, we will handle their data in the same way: asking your permission, accessing only the necessary advertising or analytics data, and caching it temporarily to provide the service. As with Facebook, we will not store your Google Ads or Klaviyo data long-term, nor collect personal identifiers from those accounts.
    • Other Non-Personal Tool Data: Some tools on our Site (for example, calculators like the Profit Scale/Efficiency Calculator or keyword generators) run entirely in your web browser. They may use your browser’s local storage or cache to remember inputs or results for your convenience, but they do not send that information back to us. In these cases, no personal data is collected or stored on our servers at all.

By providing information directly or through third-party integrations, you consent to our collection and use of it as described in this policy. You may choose not to provide certain information, but this may limit your ability to use some features (for example, not providing an email means we cannot send you a newsletter or respond to an inquiry; not connecting your Facebook account means you cannot use the Facebook Ads analysis tool).

How We Use Your Information

We use the information we collect for various purposes related to operating and improving our Site and Services. These purposes include:

  • Providing and Improving Our Services: We use your information to deliver the content or services you request, such as registering you for a course, providing access to tools, or responding to a question. We also analyze usage data and feedback to understand how our Site is used and to improve the user experience and content.
  • Communication: We may use your contact information to communicate with you. For example:
    • To send you confirmations and information about courses you registered for.
    • To respond to your inquiries or support requests.
    • With your permission, to send newsletters, marketing emails, or updates about new courses, tools, or insights. (You can opt out of marketing communications at any time – see Your Rights and Choices below.)
  • Analytics and Product Research: We use analytics data (like browsing behavior and tool usage) to understand traffic to our Site and what content or tools are most useful to our visitors. This helps us make informed decisions about new features, courses, and content offerings. For example, tracking how many users use a particular tool can tell us if it’s valuable and should be expanded.
  • Advertising and Marketing: We use data collected (through cookies and pixels) to run advertising campaigns and measure their effectiveness. For instance, information from the Facebook Pixel or Google Ads tags on our Site helps us:
    • Remarket our content to you on platforms like Facebook or Google (showing ads to people who have visited our Site).
    • Measure conversions and understand which ads or marketing messages are effective in bringing users to our Site or getting them to sign up.
  • Security and Preventing Misuse: We may use data (like IP addresses or activity logs) to protect the security of our Site, our users, and our company. This includes monitoring for fraudulent activity, network threats, or violations of our Terms of Service.
  • Legal Obligations: If necessary, we will use or disclose your information to comply with applicable laws, regulations, legal processes, or enforceable governmental requests. For example, responding to a court order or preventing harm.

We will only use your personal information for the purposes it was collected for (or purposes closely related to those purposes). If we need to use your information for an unrelated purpose, we will notify you and obtain your consent when required by law.

Cookies and Tracking Technologies

We and our third-party partners use cookies and similar tracking technologies to operate and analyze our Site and to deliver a better experience for you. Here’s how we use these technologies:

  • What Cookies Are: Cookies are small text files placed on your device that allow us or a third party to recognize your device and collect certain information. We may use both session cookies (which expire when you close your browser) and persistent cookies (which remain on your device for a set period or until deleted).
  • Our Use of Cookies: Our Site uses cookies to remember your preferences (e.g., your login session or tool settings), keep you logged in to your account, and generally make your navigation easier. We also use cookies and similar technologies (like HTML5 web storage and tracking pixels) to gather usage data for analytics and marketing (as described below).
  • Analytics Cookies: We use Google Analytics, a web analytics service provided by Google, to collect information about how visitors use our Site. Google Analytics cookies allow us to see aggregate data such as which pages are visited, how long users stay, and how they found our Site. This information is helpful for improving content and site performance. Google Analytics operates through its own cookies and may also use other identifiers. The data we get from Google Analytics does not include personally identifiable information (we do not see individual names or emails in analytics reports). Google provides an option to opt out of analytics tracking (for example, via the Google Analytics Opt-out Browser Add-on).
  • Advertising Cookies (Pixels): We use advertising-related cookies and pixels to help with our marketing:
    • Facebook Pixel: Our Site uses the Facebook Ads conversion tracking pixel. This tool, provided by Facebook, Inc., places a cookie on your browser that allows Facebook to collect or receive information about your visit to our Site and other websites. We use the Pixel to understand the effectiveness of our Facebook ad campaigns and to retarget ads to users who have visited our Site. For example, if you visited a course page, we might later show you an ad on Facebook related to that course. The data collected via the Facebook Pixel is also subject to Facebook’s Privacy Policy. You can opt out of Facebook and other companies’ interest-based ads through your Facebook account settings or via http://www.aboutads.info/choices.
    • Google Ads Cookies: Similarly, we use Google Ads conversion tracking and remarketing tags. Google’s cookies (such as the DoubleClick cookie) help us understand if you clicked an ad to reach our Site and allow us to show you targeted advertisements on Google or its partner websites. Google may collect data about your visit to our Site to provide targeted advertising. Users can opt out of Google’s personalized ads by visiting Google’s Ads Settings.
  • Other Third-Party Cookies: In addition to Facebook and Google, our email marketing provider (ActiveCampaign) might set a cookie if you interact with email sign-up forms or marketing emails (for instance, to remember that you already subscribed or to track that you opened an email). Additionally, our website platform (WordPress) uses cookies for its core functionality, such as managing user logins and preventing spam (e.g., plugins like Cleantalk for spam protection may use cookies).
  • Your Choices for Cookies: Most web browsers automatically accept cookies, but you can modify your browser setting to decline cookies or alert you when cookies are being sent. Please note that if you disable cookies, some parts of our Site (like staying logged in or using certain tools) may not function properly.
    • You can also use tools and settings provided by some third parties to control cookie tracking. For example, you can opt out of Google Analytics as mentioned above, or opt out of targeted advertising through the Network Advertising Initiative’s consumer opt-out or the Digital Advertising Alliance’s WebChoices tool.
    • Our Site currently does not respond to “Do Not Track” (DNT) signals from browsers because there is not a consistent standard for how to interpret them. We treat all users’ data according to this Privacy Policy, regardless of a DNT signal.

Third-Party Services and Sharing of Information

We use several third-party service providers and partner integrations to operate our business and provide the Services to you. We share information with these third parties only to the extent necessary for them to perform their functions for us, and each operates under its own privacy policies and, where applicable, data processing agreements with us. Key third-party services we use include:

  • ActiveCampaign: We use ActiveCampaign (an email marketing and CRM platform) to store our mailing list and manage email communications. If you sign up for a newsletter, download a lead magnet, or enroll in a course, your name, email, and other contact details may be added to ActiveCampaign so we can send you the requested content or future updates. ActiveCampaign helps us track email subscription status (opt-ins and opt-outs) and email engagement (opens, clicks) to improve our communications. You can unsubscribe from our marketing emails at any time by clicking the “unsubscribe” link in the footer of those emails, or by contacting us.
  • WordPress and Plugins: Our Site is built on WordPress, and we use trusted WordPress plugins to provide functionality. For example, WPForms powers our contact and signup forms, LearnDash manages our course content and enrollment, and WP Fusion connects our WordPress user data with ActiveCampaign. These plugins may process data you provide (such as form submissions or course progress) within our website environment. They do not use your data for their own purposes, but rather help us manage the information for our purposes (e.g., enrolling you in a course and tagging your account with relevant info in ActiveCampaign).
  • Google Analytics: (See above under Cookies and Tracking for how Google Analytics collects and processes data on our behalf.) Google Analytics may process usage data of our Site users. Google’s role is to provide aggregate analytics; it does not get your name or account details from us.
  • Facebook and Google Ads: (See Cookies and Tracking above.) Facebook and Google act as third-party advertising partners. We embed their pixels which allow those companies to collect data about your device and browsing on our Site for ad targeting and measurement, which they use in accordance with their own privacy policies.
  • Facebook API (for Tools): When you connect your Facebook account for using our ad analysis tools, Facebook provides us with an access token and data through their API. Facebook is a third-party provider of that data. We handle it as described (temporary use only), and Facebook may log that you authorized our app to access certain data. You can revoke that access at any time via your Facebook account settings.
  • Other Service Providers: We may also use web hosting providers, analytics or optimization services, and other IT or professional service providers in the normal course of business. These parties (for example, our web hosting company) might incidentally process data (such as storing data on a server or making backups) but are not allowed to use your personal information for anything other than providing the service to us.

We do not sell your personal information to third parties. We may share information in the following circumstances:

  • With Service Providers and Partners: as described above, for them to perform services on our behalf.
  • For Legal Reasons: If we are legally required to disclose information, or if we believe in good faith that such disclosure is necessary to comply with a legal obligation or request (for example, to comply with subpoenas, court orders, or regulatory requests), to protect and defend our rights or property, to prevent fraud, or to protect the personal safety of our users or the public.
  • Business Transfers: If growthzacks consulting LLC is involved in a merger, acquisition, sale of assets, or other business transaction, user information (which is part of the business assets) may be transferred to the successor or new owner. If such a transfer occurs, we will ensure the new owner is bound by terms protecting your personal data at least as much as in this policy, and we will notify you (for example, via a notice on our Site or email) of any such change in ownership or control of your personal information.
  • With Consent: We may share your information for any other purpose disclosed to you and with your consent. For instance, if we ever wanted to post a customer testimonial or case study that includes your information, we would seek your explicit permission.

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes for which we collected it, including for any legal, accounting, or reporting requirements.

  • Account Information: If you create an account on our Site, we will retain your account data (such as your username, email, and course enrollment details) as long as your account is active or as needed to provide you with Services. If you wish to delete your account, you can contact us to request deletion (see Your Rights and Choices below). Even after an account deletion, we may retain certain information as required by law or for legitimate business purposes (e.g., maintaining transaction records, or evidence of consent) but we will securely archive or isolate it from active use.
  • Mailing List Information: If you have joined our email list, we will retain your contact information until you unsubscribe or ask us to remove your data. Upon opting out of marketing emails, we may keep minimal information (like your email address) on a suppression list to ensure we respect your opt-out.
  • Tool Data (Third-Party Integration): Data retrieved from third-party accounts (such as Facebook Ads data via our Rolling Reach Report tool) is not stored long-term. We cache this data on our servers only for the short duration necessary to process your request and deliver results. Cached data is periodically cleared and is not used for any other analysis beyond your specific use of the tool. In most cases, this means that once the analysis or session is complete, that data is removed or anonymized. We do not build personal profiles or history of your third-party account data across multiple sessions.
  • Analytics Data: Data collected via Google Analytics and other tracking technologies is retained as per those service providers’ policies. Google Analytics data is typically retained for a set period (e.g., 14 months) that we configure, and we only view it in aggregate form. We don’t personally identify individual site visitors from this data.
  • Web Server Logs: Our web host may keep server logs (which include IP addresses of requests) for security and troubleshooting purposes. These logs are usually rotated or deleted within a short timeframe unless needed to investigate issues.
  • Legal Retention: If we need to retain your information to comply with laws or legal processes, we will retain it for the required period (for example, retention of transaction records for tax or accounting purposes if applicable).

When we have no ongoing legitimate need to use or retain your personal information, we will either delete it or anonymize it (so it can no longer be associated with you), or if deletion/anonymization is not possible (for example, because your personal information was stored in backup archives), we will securely store it and isolate it from any further use until deletion is possible.

Data Security

We take the security of your personal information seriously. We implement reasonable administrative, technical, and physical safeguards designed to protect your data from unauthorized access, use, alteration, or disclosure. These measures include:

  • Encryption of data in transit (our Site uses HTTPS/SSL to encrypt information you input).
  • Secure hosting environment with firewall and monitoring.
  • Limited access to personal information: only personnel and service providers who need the data to perform a specific job or service have access to personal data, and they are obligated to confidentiality.
  • Regular updates and patching of our website platform and plugins to protect against security vulnerabilities.

However, please note that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You share and transmit information at your own risk. In the unfortunate event of a data breach that affects your personal information, we will notify you and the appropriate authorities as required by law.

Your Rights and Choices

You have certain rights and choices regarding your personal information. We are committed to providing you with access and control over your data in line with applicable laws.

  • Access and Correction: You may request access to the personal information we hold about you and ask that we correct or update any inaccuracies. For example, if you have an account, you can log in to review and update some of your information (like your email). For any data not accessible via your profile, contact us and we will assist you.
  • Account Deletion: If you have created an account on our Site and would like to delete it, you may contact us at zack.miller@growthzacks.com with your request. We will delete or anonymize your account information, except to the extent we need to retain certain data for legitimate reasons (as noted in Data Retention above).
  • Marketing Communications: If you no longer wish to receive our newsletter or promotional emails, you can opt out at any time. To do so, click the “unsubscribe” link in any marketing email we send, or send us a request to be removed at zack.miller@growthzacks.com. Please note that even if you opt out of marketing messages, we may still send you transactional or informational emails related to Services you’ve requested (such as an email confirming a course enrollment or responding to a direct inquiry).
  • Opt-Out of Analytics and Ads:
    • Google Analytics: You can prevent Google Analytics from recognizing you on return visits to this Site by disabling cookies in your browser or by installing the Google Analytics Opt-out Browser Add-on.
    • Targeted Advertising: You can control the collection of data for interest-based advertising. For instance, you can opt out of Facebook’s targeted ads through your account settings on Facebook (under Ad Preferences). Likewise, you can opt out of Google’s personalized ads via Google Ad Settings. Additionally, you can use industry opt-out sites like the NAI Opt-Out or DAA WebChoices to opt out of many participating advertising networks at once. Keep in mind that opting out of ad networks does not mean you will no longer see ads, only that those ads may be less relevant to your interests.
  • California Privacy Rights: If you are a California resident, you have specific privacy rights under the California Consumer Privacy Act (CCPA) as amended by the CPRA. These include the right to know what personal information we collect, how we use it, and the categories of third parties we share it with; the right to access the information we have collected about you; the right to request deletion of your personal information (with certain exceptions); the right to correct inaccurate personal information; and the right to opt-out of the “sale” or “sharing” of your personal information (note: we do not sell personal data, and we only share your data with third parties for the purposes outlined in this policy, which is generally considered a “business purpose” rather than a “sale”). You also have the right not to receive discriminatory treatment for exercising these rights. To exercise any applicable rights, please contact us at zack.miller@growthzacks.com. We will verify your identity and respond as required by law.
  • GDPR and International Rights: If you are located in the European Economic Area (EEA), United Kingdom, or other regions with data protection laws, you may have additional rights under those laws (such as the General Data Protection Regulation, GDPR). These may include the right to object to or restrict processing of your data, and the right to data portability. Our lawful bases for processing your data typically include your consent (for example, when you sign up for our mailing list or agree to cookie tracking) and our legitimate interests (for example, using minimal data to analyze and improve our services or to prevent fraud). If you wish to exercise any rights under GDPR or similar regulations (such as accessing, correcting, or deleting your data, or withdrawing consent), please contact us. We will consider and act upon any such requests in accordance with applicable laws.

We will not charge you for exercising your rights in most cases. If we cannot fulfill a request (for example, if it jeopardizes the privacy of others or if we are legally permitted to refuse), we will explain the reasons in our response.

Children’s Privacy

Our Site and Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you are under 13, please do not use this Site or provide any information. If we learn that we have inadvertently collected personal data from a child under 13 without proper consent, we will take steps to delete that information as soon as possible.

We do not specifically restrict access for teens (individuals over 13 but under the age of majority); however, our content is business-focused and not intended for minors. If you are between 13 and 18, you should use our Site only with the involvement or permission of a parent or guardian. Parents are encouraged to supervise their children’s online activities and consider using parental control tools available from online services and software providers.

International Users and Data Transfers

Although our Services are primarily intended for users in the United States, our website can be accessed by users around the world. If you are visiting our Site from outside the United States, please be aware that your information will be transferred to and stored on servers in the United States (and potentially in other countries where our service providers maintain facilities). The data protection and privacy laws in these countries may not be as comprehensive as those in your country.

However, we will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions where we process it. For example, when we transfer personal data from the European Economic Area or United Kingdom to the United States, we rely on legal mechanisms such as standard contractual clauses or your consent.

By using our Site and providing information to us, you acknowledge the transfer of your personal information to the United States and the processing of your information in accordance with this Privacy Policy.

Changes to This Privacy Policy

We may update or modify this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes to how we treat your personal information, we will notify users by updating the effective date at the top of this policy and posting a prominent notice on our Site. In some cases, we may also notify you via email or other contact information if you have provided such information.

We encourage you to review this Privacy Policy periodically to stay informed about our data practices. Your continued use of the Site after any changes to this Privacy Policy constitutes your acceptance of those changes.
